1. Introduction
1.1 These terms and conditions apply specifically to all the Sunflower Effect Professional Training Programmes. Please be aware of a different set of terms and conditions for the Sunflower Effect Confidence Courses aimed at participants of those courses.
1.2 Please read these terms and conditions that relate to the Sunflower Effect Professional Training Services carefully before booking a place on one of the training programmes. By registering for any of the Sunflower Effect Professional Training Programmes or related services on this site, you agree to be bound by these terms and conditions. If you are not willing to be bound by these terms and conditions please do not register for the training programme.
1.3 The nature and scope of the training services to be provided by Claire Schrader are set out in detail in the specific description of the training course or services described on this (Making Moves) website.
1.4 All training programmes and events will be held in English.
2. Prerequisites for attendance
2.1 The Sunflower Effect Professional Training Programmes are not suitable for individuals under the age of 25. This is because we believe you need more life experience to deliver the Sunflower Effect Confidence Courses. Please book an interview with Claire Schrader if you are under 25 and wish to train. There will be a charge for this £60. It will be at her discretion as to whether she will accept you on the programme. You may not purchase any services from our site if you are below the age of 18 years old because, under this age, you do not have the legal capacity to enter into a contract.
If you are new to the Sunflower Effect or dramatherapy, we recommend participating in the Sunflower Effect Courses so you are familiar with the ethos and approach.
3. Payment
3.1 When you express your intention to register for a training programme or any of the other services Claire Schrader provides, you will receive an email containing details of how you register for the training either online or offline.
3.2 The total price payable for the Sunflower Effect Professional Training Courses is specified on the Making Moves website or in the Course Information Pack or in your booking email or other email correspondence you may have received.
3.3 In order to secure your place, a non-refundable deposit is required. You also may pay in full. There are a limited number of places on each training course, so it is advisable to book your place as soon as you can. The deposit is, in all cases, non-refundable. See the relevant training course or workshop information on the Making Moves website or in your booking email. Please be aware that if you pay through our booking system there is 1.7% booking fee. There is no booking fee if you pay by electronic bank transfer.
3.4 Your registration will be acknowledged in writing via e-mail after registration, provided that all necessary information is complete and the deposit (as a minimum) has been received. The acknowledgement contains details on the training programme, the venue for the training and other relevant information.
3.7 If you choose to pay by instalments, it is your responsibility to ensure that your instalments have been paid and to take action if there is an issue. Without prejudice to any other right or remedy that we may have, if any sum payable under these terms is not paid within 7 days of the date due we reserve the right to (i) charge interest from the date due for payment to the actual date of payment at the rate of 3% above the base rate of Santander Bank from time to time in force and/or (ii) suspend the availability of the Programme until such time as payment is made or the Contract is terminated. We would prefer not to resort to this action, so please contact Claire Schrader at the earliest opportunity if your circumstances change so as to resolve any issue or to make a new arrangement.
3.10 When you register for the training programme you will be asked to supply the following data: your full name; e-mail address; company or organisation name (if being sponsored by an organisation); your address and contact information; details of how you will pay for the balance of your course fees if relevant; and information about your training and background.
3.11 Despite our best efforts, there may be incorrect prices on some of the services or products. If the correct price is less than the price shown on our site, the lower amount will be charged. If the correct price is higher than the price specified on our site, we will inform you of this and ask whether you wish to continue with the order at the actual higher price. If the error in price is obvious, unmistakeable and mispricing could have been recognised reasonably by you, we will not be liable to provide the services or products to you at the lower price that was incorrect.
3.12 If there is any conflict between these Terms and any term of the order (the registration details), the order will take priority.
4. Our obligations
4.1 Claire Schrader is responsible only for providing the training, not for the success or the outcome of the training. Due to the nature of the training and the fact that your success is dependent on a number of factors over which Claire Schrader has no control, we do not guarantee any particular results. Optional support services will be available in the form of supervision, coaching, marketing and online resources, to enable you to build the skills you need to run successful courses. These services will carry a separate fee. You are advised to take advantage of this support.
4.2 Claire Schrader warrants to you that the Programme and Programme materials purchased from her are of a satisfactory quality and reasonably fit for the purpose for which the Programme is supplied.
4.3 Claire Schrader will endeavour to ensure that all information that she provides is accurate and up-to-date but she shall not be liable for any claims arising from such information being inaccurate or not up-to-date or otherwise. But please do inform us of any inaccuracies you find.
4.4 Claire Schrader acknowledges that in the course of the Programme she will have access to your confidential information and she agrees not to (except in the proper course of her duties) use or disclose to any third party such confidential information.
4.5 Privacy Policy and Acceptable Use Policy. Registration and other information provided by you is subject to our Privacy Policy and shall only be used in accordance with it. For more information, please go to our GDPR privacy and data protection policy.
4.6 The online sessions of the programme are held on third-party secure servers and we have taken all reasonable steps to ensure that the online content will be available at all times during the course of the programme but in the event that such content (or any content added by you or other participants in the Programme) is not available in whole or in part at any time, or becomes corrupted, is deleted or is failed to be stored, we shall have no liability in any circumstances.
5. Certification and Licensing
5.1 We will issue an attendance certificate for the Sunflower Effect Course Leader Foundation Training after the full training payment has been received and participation has been completed. The validity of the attendance certificate will be noted on the certificate – as to what courses and events you can run as a Course Leader In Training until you have applied for licencisng. A certificate of attendance will be issued showing the number of hours that you have attended either online or in person. You will be responsible for making up any training you have missed, and demonstrating that you have absorbed the content of any recorded sessions when you apply for licensing (please be aware that there will be an extra fee on top of Application Fee for Licensing (currently £195) for Claire Schrader’s time in reviewing any extra material you supply as proof that you have absorbed the content of missed sessions. See below for details of the requirements for delivering the Sunflower Effect Confidence Courses to paying participants.
5.2 The Sunflower Effect Course Leader Foundation Training is the first stage in a longer modular training process with the option to train to deliver the full range of the Sunflower Effect Confidence Courses.
5.4 Upon completion of the Sunflower Effect Course Leader Foundation Training and having met the requirements for delivering the Sunflower Effect Confidence Courses, you can apply to be licensed as a Sunflower Effect Confidence Specialist upon payment of the appropriate license fee. The license fee will vary according to what area of practice you will be pursuing i.e. private practice, public sector, consultancy. You will be authorised only to deliver the Sunflower Effect Confidence Courses that you are licensed to deliver.
5.5 Upon completion of the Sunflower Effect Course Leader Foundation Training as described in 5.1. each successful graduate will need to fulfil the requirements for delivering the Sunflower Effect Confidence Courses to the desired standard. The requirements will vary according to your previous training and experience but will involve running a number of practice groups/courses. You will have permission to charge for your services (to cover your costs) and will be required to be in supervision whilst running your practice courses.
5.6 The certificate of attendance for the Sunflower Effect Course Leader Foundation Training or any other training programme, does not allow trainees to train other parties or further employees unless a special agreement is made between the trainee/sponsor and Claire Schrader. Only trainers trained directly by Claire Schrader are considered as properly trained and authorised to deliver the Sunflower Effect Professional Training Programmes.
6. Intellectual Property
6.1 Claire Schrader is the owner or the licensee of all Intellectual Property Rights and all other rights in the programme and all content within the programme and nothing in these Terms or otherwise shall operate to transfer the ownership of the Intellectual Property Rights in the programme or the content of the programme to you or to any other person.
6.2 The content and materials in the programme are for your sole use only. You may not at any time copy, reproduce, publish in any form, share, sell, dispose of or otherwise make available to a third party in any way any of the content or materials contained in the programme.
6.3 Claire Schrader grants to you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use all or any of the content of the Programme for the purposes for which the programme was provided only. You may not “reclothe” the Sunflower Effect Confidence Courses and set up a rival service in competition with other Sunflower Effect Confidence Course Leaders/Specialists without seeking permission from Claire Schrader. However, we will be encouraging you to take what you have learned from the training and take it to populations where the Sunflower Effect is needed.
6.4 Except as set out in paragraph 5.3, you may not use any of our intellectual property rights at any time except where duly licensed. Use of our logo is strictly prohibited without Claire Schrader’s prior written consent. When you become licensed as a Sunflower Effect Course Leader and join the team of Sunflower Effect Confidence Course Leaders/Specialists, you will be granted limited permission to use the Sunflower Effect logo and Claire Schrader’s graphic design resources in order to promote the Sunflower Effect Confidence Courses in your location.
6.5 You may not, without Claire Schrader’s prior written consent, make any audio or visual recordings of any part of our Programme.
6.6 We may record the Programme being delivered during your attendance for the benefit of training participants who are absent and as a record for you to refer to after you have completed the training. We may also use short clips from the programme to promote future Sunflower Effect Training Programmes. You authorise us to use your image and voice in any such recordings without payment, other condition or need for further consent.
6.7 You acknowledge that certain information contained in the Programme and Programme materials is already in the public domain.
6.8 You are not permitted to sell or promote products or services to other participants in the Programme at or during any part of our Programme without Claire Schrader’s prior written permission.
6.9 The provisions of this paragraph 6 shall survive termination of the Contract.
7. Cancellation
7.1 Before we begin to provide the services, you have the following rights to cancel our services:
- You may cancel your place on the Foundation Course in writing up to sixty (60) calendar days prior to the start date of the training (minus 100% of the non-refundable deposit and any fees paid to the payment gateway if payment was made by credit or debit card through our booking system). However, if you are able to provide a suitable replacement who has paid in full, paid the non-refundable deposit or has set up a payment plan, we will refund your deposit (minus any fees paid to the payment gateway) when full training fees have been received.
- Cancellation up to thirty-one (31) days before the start date of the Foundation Training will be charged at £250 (plus 100% of the non-refundable deposit and any fees paid to the payment gateway if payment was made by credit or debit card through our booking system) unless you are able to provide a replacement – see above.
- Cancellation in less than fourteen (14) days prior to the training, will be charged at 50% of the total fees received and 100% of the non-refundable deposit.
- Cancellation in less than seven (7) days prior to the training, or non-appearance of a registered participant at the training event, will be charged 100% of the fees received. See paragraph 3.8. Claire Schrader may at her discretion, offer you an opportunity to transfer a proportion of the fees paid to the next time she offers the training course.
7.2 We have the right to cancel or defer a training course due to circumstances beyond our control. In the event of a cancellation, Claire Schrader will reimburse any course fees paid (minus any non-refunded fees paid to the payment gateway if payment was made by credit or debit card), and Claire Schrader’s liability will be limited to the value of the course fees paid. In the event of the training being deferred, Claire Schrader will transfer the training fees already paid to the next available training. Claire Schrader will reimburse any course fees paid (minus any non-refunded fees paid to the payment gateway if payment was made by credit or debit card though our booking system).
7.3 In the event that you need to leave the training course after the training course has started, please see paragraph 3.8.
8. If there is a problem with the services
6.1 In the unlikely event that there is any defect with the Sunflower Effect Professional Training Services:
- Please contact Claire Schrader and tell her as soon as reasonably possible.
- Please give Claire Schrader a reasonable opportunity to repair or fix any defect.
- Claire Schrader will use every effort to repair or fix the defect in a reasonable time scale.
6.2 As a consumer, you have legal rights in relation to training services not carried out by Claire Schrader with reasonable skill and care. After following the steps in 8.1. and giving her reasonable opportunity to fix the defect, you must inform Claire Schrader at any time from the date of commencement of the Training Programme by emailing her and clearly stating how the Training Programme was not carried out by Claire Schrader with reasonable skill and care. If we agree (acting reasonably) that the Training Programme was not carried out by Claire Schrader with reasonable skill and care (rather than as a result of your action or inaction or your personal shortcomings) she may provide you with a refund of the amount paid by you (minus any non-refunded fees if payment was made by credit or debit card) or may make a partial refund. This is at Claire Schrader’s discretion
These terms and conditions shall continue until the end of the Sunflower Effect Training Programme when this contract shall expire other than for the Terms that are specifically stated to remain in force.
